Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of InsuranceOS, operated by Brutally Honest Software, LLC ("Company," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. The service

InsuranceOS is a policy-management and workflow platform for independent insurance agencies. We provide it "as is" and may update, modify, or discontinue features with reasonable notice.

3. Accounts and access

• You must provide accurate information when creating your account. You are responsible for keeping your credentials secure.
• Each subscription is for one agency organization. Sharing login credentials across organizations is not permitted.
• You may invite team members within your organization up to the seat limit of your plan. Additional seats are billed at the per-seat rate.

4. Billing and payment

• Subscriptions are billed monthly or annually in advance. All prices are in USD.
• New subscriptions include a 45-day free trial. No charge is made until the trial ends.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial periods.
• If a payment fails, we will attempt to collect for up to 14 days. Access may be suspended for non-payment.
• We reserve the right to change pricing with 30 days' notice. Price changes apply at your next renewal.

5. Your data

You retain full ownership of all client records, policies, and other data you enter into InsuranceOS. By using the service, you grant us the limited right to store and process that data solely to provide the service to you. We will never use your agency data to train models, sell to third parties, or use for any purpose other than operating InsuranceOS for your account.

6. Acceptable use

You agree not to:

• Use the service for any unlawful purpose.
• Enter data about individuals without their knowledge or in violation of applicable privacy laws (HIPAA, CCPA, GLBA).
• Attempt to access another organization's data.
• Reverse-engineer, scrape, or otherwise extract data or functionality from the platform.
• Resell or sublicense access to the service.

7. Compliance

InsuranceOS is a workflow tool. You are solely responsible for ensuring your use of the platform complies with applicable insurance regulations, licensing requirements, and federal and state privacy laws including HIPAA, GLBA, and the CAN-SPAM Act. We do not provide legal, compliance, or tax advice.

8. Uptime and support

We target reasonable availability but do not guarantee any specific uptime SLA at this time. Support is available by email at support@getinsuranceos.com. We will respond to support requests within 2 business days.

9. Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

10. Termination

Either party may terminate at any time. We may suspend or terminate your account if you materially violate these Terms. Upon termination, we will provide 30 days to export your data before deletion.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Texas.

12. Changes to these terms

We may update these Terms. Material changes will be emailed to account holders at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
